As of January 12, 2009, EPA may now assess fines up to $37,500 per violation per day for certain RCRA violations. This $5000 increase is mandated periodically by the Civil Monetary Penalty Inflation Adjustment Rule which requires the federal government to assure that fines keep up with inflation. The purpose is to avoid situations where companies or individuals continue violating and consider the fines a “cost of doing business.” The last increase taken by EPA was on March 15, 2004, when the RCRA penalty rose from $27,500 to $32,500.
